General
The following terms and conditions are valid between you and Frédérique Bruijnen (Frédérique Bruijnen; may be referred to as “us” and “we”) and apply to all use of and orders placed on Frédérique Bruijnen website www.frederiquebruijnen.com, and orders made by telephone, e-mail or by live chat with Frédérique Bruijnen Customer Service team. Please note that Frédérique Bruijnen does not guarantee that all artworks presented on the Website are in stock or are available for purchase. Frédérique Bruijnen reserves its right to stop selling a artwork. Orders can only be placed by persons that are 18 years or older.
Frédérique Bruijnen reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found in the final section of the Terms and Conditions. Each purchase is subject to the Terms and Conditions in the version applicable at the date of submitting the order. Please inform yourself about the applying version of Terms and Conditions before submitting your order. Please note that the terms and conditions valid for your order is always the terms and conditions that you have read and accepted before you have placed your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.
Language
The language of the Terms and Conditions is English.
Placing order
By using the Website and/or placing an order on the Website, by telephone, e-mail or by live chat you confirm that you have read these Terms and Conditions and the Privacy Policy, and that you accept them. Please make sure that you have read and understood the Terms and Conditions before you place an order. An order can only be placed if you have previously confirmed that you accept these Terms and Conditions. Before you place your order, you will be given the opportunity to review your selections, the information you have provided, the total price of your order and correct any input errors. Please note that artwork in your shopping bag are not reserved and may be purchased by other customers until you have placed the order at checkout and received the order confirmation email. If prolonged inactivity causes your connection to the Website to fail, your selection of artworks may be lost. In such case, you will be required to re-enter your selection of artworks to the shopping bag.
Order confirmation
After submitting your order, we will send you an order confirmation e-mail with your order number, details of the artwork(s) you have ordered from us, your payment details and delivery details. Please note that the confirmation e-mail is an acknowledgement that we have received your order and is not an acceptance of the order.
Acceptance & shipping information
Please note that all orders placed by you are subject to acceptance by us. We may, at our discretion, choose not to accept your order for any reason whatsoever without any liability to you. Once the order has been processed, a shipping confirmation e-mail will be sent with all relevant information about your order and these Terms and Conditions. The shipping confirmation is our acceptance of your order. Please note that Frédérique Bruijnen does not guarantee that all artworks presented on the Website are available at the time of your order. If an artwork is not available, we will contact you shortly, by phone or by e-mail. If we already have received your payment for this artwork we will refund you the amount of the purchase.
Colors
Frédérique Bruijnen’s goal is to describe the artworks at the Website as correctly as possible. However, please note that due to the color settings of your computer, the colors of the artworks shown in the pictures on the Website can differ somewhat from their actual colors. Frédérique Bruijnen cannot be held responsible for any such discrepancy.
Prices
The prices and delivery costs shown on the Website all include VAT. The prices and delivery costs shown on the Website may vary from time to time and Frédérique Bruijnen is not bound by the price until Frédérique Bruijnen has accepted the order by sending the shipping confirmation to you. The prices may also vary between the physical studio and exhibitions and the Website. If you have placed an order and the price has changed before we have accepted your order (by sending you the shipping confirmation), we will notify you by e-mail about the price change and give you the option to place a new order with the new price or cancel the old order.
If we are unable to contact you, your order will be cancelled. Frédérique Bruijnen always reserves the right to cancel any order prior to our acceptance of the order. If we already have received payment for a cancelled order we will refund you the amount of the purchase. The refund is made using the same payment method which you used at the purchase. Please also note that Frédérique Bruijnen may cancel the order even if it has been accepted by Frédérique Bruijnen under the condition that you realize or should have realized that the price information was incorrect. The delivery costs are shown in connection with the shipping methods at the checkout stage.
Payments
The following payments are accepted:
- Online banking
- Ideal – Pay by using direct online transfer from your bank account through Ideal.
- Paypal
When selecting the PayPal option, you will be directed to the PayPal site to “Log In” and review the amount shown before clicking “Pay Now”. Once this transaction is complete, you will then return to the Website.
Information of the right of cancelation
Right of cancelation
You are entitled to cancel this contract within 14 days without giving reasons. The cancelation period is 14 days from the day on which you have, or a third person designated by you (other than the carrier) has, received the artworks. In order to exercise your right of cancelation, you must inform us at info@frederiquebruijnen.com by means of an unambiguous notification (e.g. through letter sent by post, fax or e-mail) of your decision to revoke this contract. You may electronically complete and submit the specimen cancelation form provided on our website. This is, however, not compulsory. In order to comply with the time limit for cancelation, it is sufficient that you send the notification of the exercise of the right of cancelation before the time limit for revocation expires.
Consequences of cancelation
If you cancel this contract, we are obliged to return to you, promptly but in no case later than within 14 days from the day on which we have received the notification of your revocation, all payments that we have received from you including the costs of delivery (except any additional costs that result from you having chosen a different method of delivery than the cheaper method offered by us). For such repayment, we will use the same means of payment that you have used for the initial transaction unless expressly agreed with you otherwise; in no case will we charge you any fees due to such repayment. We are entitled to refuse repayment until we have recovered the artworks or you have evidenced that you have sent the artworks back to us, whichever occurs first. You are obliged to send back or hand over the artworks to us promptly, but in no case later than within 14 days from the day on which you notified us of the revocation of this contract. The time limit is complied with if you send the artworks before the expiration of the 14 days’ time limit. You have to bear the direct costs of the reconsignment of the artworks. Any potential loss in value of the artworks will have to be compensated by you only if such loss in value is attributable to your handling of the artworks which is not necessary for the verification of their condition, quality or functionality.
Shipping costs for reconsigning the artworks
Please note that you must pay the shipping costs for returning the artwork(s) in accordance with your right of withdrawal and exchange and Frédérique Bruijnen has no obligation to pay such costs.
Returning the artworks
You can easily and conveniently handle the reconsignment of your purchased artworks as following:
– Return it to the studio, or
– Send it back at your own cost, by:
Wrap the artwork(s) in the original wrapping foil;
Place the artwork(s) in the original shipping box, or any other solid carton box;
Close the box and tape it securely;
Place the return information label and the already paid return shipping label on the box over the prior delivery information.
Conditions
If you are shipping a faulty or damaged artwork, a refund will be given upon inspection of the item. A refund will not be given if the item has been damaged by the user or is reparable. We are first given the opportunity to repair your artwork or replace the item before a refund is given. If you are returning an artwork for refund or repair, *the artwork MUST be returned in either the original packaging or in a hard case to prevent crushing whilst in the post. Items that are incorrectly packaged and subsequently crushed in postage cannot be replaced. Items that have clearly been used and damaged either deliberately or by accident are not considered faulty and will not be accepted.
Damaged artworks
If you receive damaged artworks, please notify us immediately. According to the Civil Act you are entitled to complain about defective artworks within one year. However, you must always notify Frédérique Bruijnen within a reasonable time after you have detected that the artworks are defective. If Frédérique Bruijnen consider the artworks to be damaged, Frédérique Bruijnen will make a full refund including shipping costs. Please make sure you make several clear pictures of the artwork, as a whole and of the damaged part.

You are authorized to use this material only for personal, non-commercial purposes. You may download, print and store copies of this material for your own personal, non-commercial use, provided this Copyright Permission Notice is included in all such copies. You may not charge anyone for use of the material and you may not publish, duplicate or otherwise distribute the material to others without prior consent from Frédérique Bruijnen. You may purchase artworks on www.frederiquebruijnen.com for personal use only and not for resale. By placing an order on www.frederiquebruijnen.com, you certify that you are purchasing artwork(s) for your own personal use and not for resale and that you accept the Terms and Conditions. We reserve the right to refuse orders for any reason without explanation.
Information on the website
Frédérique Bruijnen cannot promise that the content of the site is free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. Frédérique Bruijnen may, at any time, amend the content of the site. Although Frédérique Bruijnen strives to display the correct texts, images and pricing on the site and online shop, errors may occur. Part of the services provided through the site are provided by third party operators. In situations where Frédérique Bruijnen acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. Frédérique Bruijnen cannot be held responsible for any damage caused from using the site or, for that matter, not being able to use the site. Violation of rules
Frédérique Bruijnen reserves the right to seek all solutions available to us against violations of these Terms and Conditions, including the right to block access to the site.
Liability
Any damage liability of Frédérique Bruijnen is excluded. Exempted from this exclusion are claims of the customer related to damages to health, body and mind, or damages resulting from a violation of material contractual obligations (cardinal duties), as well as the liability for other damages which are based on intent or gross negligence of Frédérique Bruijnen, its representatives and vicarious agents. Material contractual obligations are obligations which are precondition to the successful performance of the contract and on the observation of which the customer can legitimately rely. In the event of a violation of material contractual obligations, Frédérique Bruijnen’ liability is limited to the foreseeable and typical damage if such damage has been caused slightly negligent, unless a damage to health, body and mind is concerned. The limitations set forth above also apply for the benefit of the representatives and vicarious agents of Frédérique Bruijnen if claims are made directly against them. The liability under the Artwork Liability Act remains unaffected. Frédérique Bruijnen assumes no liability in case of force majeure such as war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. In case of force majeure, Frédérique Bruijnen’s obligations will be suspended. The contract between you and Frédérique Bruijnen can, in such cases, be partially or fully terminated by yourself or by Frédérique Bruijnen.
Provisions severability
If any part of these Terms and Conditions are held to be invalid or unenforceable, such determination shall not invalidate any other provision of these Terms and Conditions; instead the invalid terms and conditions shall be replaced with other terms in order to give effect to the commercial intentions of these Terms and Conditions.

SHIPMENTS AND RETURNS
Shipping
All artworks are unique and handmade. Your order will be shipped within 5 working days. If your artwork is required urgently, please email us at info@frederiquebruijnen.nl and we will advise you if we can meet your required delivery date.
If you are interested in a certain color or in an artwork which is sold out, you can send an email to request a similar one and we can discuss the possibilities.
Frédérique Bruijnen offers shipping for delivery within The Netherlands and internationally via DPD or PostNL. To ensure safe delivery of your purchases, we always use Express Post with signature on delivery.
Please ensure there will be someone to sign for your package when it arrives or that the post office collection card can be left in a safe place. Please nominate a current address that is a trusted residence or work place. We cannot be held responsible if incorrect details are given, or if your postal slip is stolen. If you provide us with an incorrect shipping address, and your item is returned to us, you must purchase another postage fee. Shipping costs
Bulky/ heavy/ multiple artworks and remote areas may require an additional shipping fee, which we will quote you for prior to your purchase being dispatched. Generally, international airmail will take 5-10 working days to most commercial areas. If your shipment takes longer than expected, please use the tracking number provided to see how it is travelling. Please contact us at info@frederiquebruijnen.com for information on international express post options.
Please note our prices are not inclusive of any taxation or customs charges you may be liable for on your package’s entry into your country. Please refer to your country’s government website for more information.
Order confirmation
You will receive a confirmation by email shortly after placing your order. Please re-check your shipping address for mistakes. Extra shipping cost as a result of a wrong address will be for the client’s costs. In case of mistakes please contact as soon as possible at info@frederiquebruijnen.com with the correct information.
Shipping confirmation
As soon as your order is finished, you will receive a shipping confirmation by e-mail. This email will include carrier and tracking info for your parcel.
Uncollected packages
Shipping costs for uncollected packages will not be paid by Frédérique Bruijnen.

Return policy
Are you not satisfied with the artwork? You can return it at Frédérique Bruijnen in Aalsmeer (NL).
Note: Commissioned artworks are not returnable and sales are final once the request for a commission has been accepted.
Returns will be reviewed case by case bases. The first exchange is free but you must pay for the shipment so please post the artwork to us, well packaged in its original packaging, to the address below and include a prepaid express postbag with the signature on delivery option. Email us at info@frederiquebruijnen.com to notify us that you require an exchange and the size required, and please also include a note in your package with the desired style you wish to exchange with.
When your return has been accepted, your refund will be issued and you will receive a confirmation email. A refund will be issued to your original payment method within a few days. Transfer time will vary based on your used payment method.
We will offer a full refund within 21 days from when your order is delivered. Unfortunately, we cannot refund any taxes, duties, charges or shipping fees for returns. Refunds will be done in Euros, at the price paid upon original purchase.
We do not give refunds simply because you have changed your mind. Please consider this prior to placing your order. Do not hesitate to contact us with any questions you might have about the artwork prior to purchasing it.
Before your parcel leaves our Frédérique, it has been fully checked by our team. If you, unfortunately, still received an item classified as faulty or damaged, please inform us within 7 days after receiving your order at info@frederiquebruijnen.com in order to be eligible for alternatives such as exchanges, refunds or repairs. Please accompany this request with your order number and (if needed) images to clarify the reason for this request.
All our artworks are fragile and are priced fairly to reflect the work that has been done to create them. Please treat them kindly, expect the materials to be vulnerable when packing or moving around. If any damage occurs when having it in your home or office, we are always happy to repair any damages for a reasonable fee, as long as the artwork is not completely destroyed. Please read our repair page and read our artworks pages carefully. We really appreciate your understanding.
*For encaustic artworks we strongly recommend to not put them into direct sunlight due to the chance of melting. Beeswax is a beautiful and natural material that is very fragile. You can use a piece of cotton fabric to polish it to get the shine back. If you need to pack it, please use crackled baking paper as this will protect the beeswax.
